Welcome to Incredible Days. By accessing, browsing, and using www.incredibledays.com, or by purchasing or redeeming an Incredible Days Experience Voucher or Incredible Days Gift Card Voucher, you acknowledge and agree to the following disclaimers, terms, and conditions, as well as all other applicable laws. These disclaimers, terms, and conditions may be updated by Incredible Days from time to time without notice to you. You can always review the latest disclaimers, terms, and conditions from Incredible Days at www.incredibledays.com.
Purchasing
In order to purchase an Incredible Days Experience Voucher or Incredible Days
Gift Card Voucher, you can either log-on to www.incredibledays.com or visit a
selected retail location. The buyer of the Incredible Days Experience Voucher
or Incredible Days Gift Card Voucher must provide a credit card number, at
which time the credit card will be charged the appropriate amount, and after
which an Incredible Days Gift Pack (with a voucher and voucher number) will be
sent to the recipient of the purchase. This gift pack also includes
instructions as to how to redeem the gift, as well as other selected material.
Voucher
The Incredible Days Experience Voucher or Incredible Days Gift Card Voucher
contained within the Incredible Days Gift Pack includes a unique voucher
number. This voucher number is used to identify recipients in communication
with Incredible Days, and must be presented intact to the Incredible Days
experience provider before the experience takes place. This voucher may not be
redeemed for cash, and is not a credit card or a debit card.
Redeeming the Voucher
Contained within the Incredible Days Gift Pack that the voucher was received
in, you should find the Incredible Days Information Pack. This information pack
contains the specifics as to how to redeem the Incredible Days Experience
Voucher or Incredible Days Gift Card Voucher. Please follow these directions in
order to redeem your voucher. If you have any questions please feel free to

Refunds, Lost or Stolen Cards
Except where stated, Incredible Days Experience Vouchers and Incredible Days
Gift Card Vouchers are non-refundable. Incredible Days takes no responsibility
for any loss incurred as a result of identity fraud, or loss or theft of the
voucher. In certain circumstances beyond our control, Incredible Days may need
to cancel a voucher. Incredible Days will notify the participant as soon as
possible and offer all available alternatives. In extreme circumstances of
death, injury, or illness, Incredible Days will, in limited cases, allow
customer to re-book an experience. Participants may be asked to provide
documentary evidence to support claims relating to the above, and any refunds
given by Incredible Days will be refunded only to the original purchaser.
Expiration
Incredible Days Experience Vouchers and Incredible Days Gift Card Vouchers are
valid for 12 months from the date of issue, unless otherwise required by
applicable state law. Experiences must be booked by the expiration date unless
the experience is extended prior to the expiration date (where allowable by
state law). Expiration date extensions are subject to a $20 administrative fee
per extension, plus any additional price increase in the experience or gift
package itself.
Exchanges
Unbooked experiences may be exchanged any time prior to the expiration date
(except where applicable by state law) free of charge. Booked experiences can
be exchanged as well, subject to a $25 change fee. When the new experience is
priced higher than the original experience, you will be required to pay the
difference. When the new experience is priced lower than the original
experience, you will receive a credit of the difference towards a future
Incredible Days purchase. In any exchange, the original voucher must be
returned to Incredible Days before a new one is sent to the customer.
Cancellation and Rebooking
Once you have confirmed the booking with the experience provider, cancellations
and rebooking are allowed up to fourteen (14) days prior to the experience,
unless otherwise noted at www.incredibledays.com for a particular experience.
Incredible Days cannot accommodate schedule changes after that period. Failure
to appear as scheduled and participate in your experience, or failure to cancel
and rebook the experience at least fourteen (14) days prior to the booked date,
will result in a non-refundable cancellation.
Assignability
Incredible Days Experience Vouchers and Incredible Days Gift Card Vouchers are
assignable to any third party prior to booking the experience. In order to give
an experience you’ve been given to someone else, please contact us. We will
send you out a new voucher as long as you send the original voucher back to us.
However, once assigned, the new voucher-holder must provide relevant
information to Incredible Days. In addition, the new holder of the voucher
shall be subject to these terms and conditions.
Availability
Incredible Days suggests that experiences are booked a minimum of 14 days in
advance, and further if a weekend, holiday, or popular time is desired. While
Incredible Days and the service provider will make every effort to meet your
needs, we cannot guarantee to provide your experience on a chosen day. In the
case of mechanical or equipment problems, malfunctions or unavailability, acts
of God, celebrity illness or other no-shows, Incredible Days reserves the right
to work with the experience provider to make a reasonable substitution on the
day of the experience. If substitution is not possible, then Incredible Days
reserves the right to cancel the experience on short notice. Incredible Days
will take no responsibility any losses, damages, expenses or liabilities you
incur in connection with a cancelled experience. If an experience is cancelled
by Incredible Days or an experience provider, you will be notified as soon as
possible in order to arrange a convenient date in the future for your
experience, at no additional charge.
Withdrawal of an Experience or Location
In the unlikely event that Incredible Days permanently cancels or otherwise
terminates or withdraws an experience, Incredible Days will provide you with an
alternative experience or with an Incredible Days Gift Card Voucher of equal or
similar value. In the unlikely event that Incredible Days permanently cancels
or otherwise terminates or withdraws an experience location, Incredible Days
will provide an alternative location for your experience or provide you with an
Incredible Days Gift Card Voucher of equal or similar value to the original
experience.
Equality and Accessibility
Incredible Days recognizes that persons with disabilities may have difficulty
participating in certain experiences. Incredible Days encourages the
involvement of all persons in our experiences. To help us meet your needs, we
ask that you inform us of any relevant disability when your order is placed. If

Experience Providers
Incredible Days has experience providers nationwide and is continuously adding
locations and services. However, Incredible Days is not a provider of any
experience and has no responsibility for any experience provided or not
provided by our third party experience providers. Incredible Days makes no
warranty or representation regarding the standard of any experience provided by
any experience provider. All experiences issued are subject to the terms and
conditions of the experience providers, as well as the terms and conditions
provided herein. In order to participate in the experience, participants must
accept the experience providers terms and conditions. Participants may also be
required to sign an acceptance form or a waiver by the experience provider and
will be informed of this when they redeem their voucher, or by the experience
provider at the time of the experience. Incredible Days has no power to manage
or control the operations of any experience provider. While Incredible Days
takes reasonable precautions with regard to its experience providers,
Incredible Days makes no guarantees or warranties whatsoever about the
experience provided by the experience provider.
Accuracy of Experience Descriptions
Incredible Days will use its reasonable best efforts to keep all information
regarding the experiences as accurate and up to date as possible. However, the
precise details of each experience are subject to change from time to time and
may vary among service providers and/or locations offered. The experience
description as provided in the Information Pack is only accurate at the time of
going to print and may not fully or precisely describe the actual experience
received. The service provider is ultimately responsible for the accuracy of
the description of the relevant Incredible Days experience, including without
limitation, the exact location, estimated duration, waiting times, instruction
requirements, minimum and maximum number of other participants and any other
limitations, restrictions or requirements related to the relevant Incredible
Days experience, such as age, height, physical condition, weather or other
limitations, restrictions, or requirements. The most up to date experience
descriptions are available at www.incredibledays.com. The pictures and
descriptions of Incredible Days experiences used in all promotional materials
and at www.incredibledays.com are strictly for illustrative purposes and may
not reflect the specific details of the experience.
Complaints
Problems with the experience are best rectified as early as possible with the
experience provider. If you do have any problems or complaints, please notify
the experience provider so they have the opportunity to address the problem.

Experience Restrictions
Certain experiences are subject to minimum requirements regarding age, height,
health, or other factors. Incredible Days experience descriptions and marketing
materials will, as accurately as possible, explain the limitations or
requirements relating to each experience. However, it is the participant’s
responsibility to comply with all necessary requirements relating to the
experience, as set out on the website and/or information pack. Participants may
be liable for costs if they have to cancel their experience after booking
because these requirements are not met.
Weather
Certain Incredible Days’ experiences are very weather dependent. The Incredible
Days website, as well as the information pack you receive in the gift pack will
contain information about weather conditions. If the weather is questionable,
you will need to contact the service provider on the day of the experience to
know whether the experience has been cancelled or not. You should not assume
that weather conditions will result in a cancellation of a booked Incredible
Days experience, as failure to appear will result in a non-refundable
cancellation. All experiences cancelled by the service provider due to weather
conditions will be rebooked, subject to availability, without incurring any
additional charges.
Dress Code
Some service providers recommend or require certain items of clothing to be
brought to the experience or worn for the experience. Please make sure to
comply with these requirements before setting off for your experience.
Incredible Days will not be held liable for the non-provision of an experience
due to failure to bring or wear the required clothing.
Session Length
Session lengths are approximate, vary from venue to venue and are given simply
as an indication of the time you will spend at the venue. Unless stated
otherwise, you will usually be taking turns with other people and there may be
waiting time involved. We give itineraries as a guide only and the running
order of an event may change.
Acceptance
You will be subject to the terms and conditions contained herein when you
purchase or redeem your Incredible Days voucher and/or when you book or
participate in your experience. Acceptance of these terms and conditions is a
condition of using the Incredible Days voucher whether or not you are the
original purchaser of that card or not.
Liability
Incredible Days is independently owned and operated, and is not affiliated,
directly or indirectly as owner, member, manager, stockholder, director,
officer, employee, consultant or otherwise, with any experience provider.
Incredible Days is not responsible for any matters related to experience
providers, including without limitation, the actions or omissions of any
experience providers. Service providers are individually responsible for their
health and safety standards and operating practices. Incredible Days therefore
makes no guarantees regarding the consistency or efficacy of individual
experience providers. Incredible Days makes no warranties or representations of
any kind, either express or implied, regarding any Incredible Days experiences
or the providers thereof, including, but not limited to, the implied warranties
of merchantability, information, non-infringement, and fitness for a particular
purpose. Incredible Days accepts no responsibility and shall not be liable for
any loss, injury, claim, cost, damage, or any special, exemplary, punitive,
indirect, incidental, or consequential damages (including , without limitation,
loss of profits), whether based in contract, tort, strict liability or
otherwise which arises out of or is any way connected with 1) the use and
redemption of the Incredible Days Voucher or 2) the performance or
nonperformance by any experience provider even if all parties have been advised
of the possibility of damages. Incredible Days shall under no circumstances be
liable for any delay or failure in performance resulting directly or indirectly
from acts of nature, forces or causes beyond its reasonable control. By
purchasing and/or redeeming an Incredible Days Experience Voucher or Incredible
Days Gift Card Voucher, you hereby release and forever discharge and promise
not to sue or assert against Incredible Days and its subsidiaries, parents and
affiliates and their respective members, managers, officers, authorized
representatives and agents and employees from any and all claims, causes of
action, damages, losses, liabilities, expenses and costs whatsoever that you or
your heirs, successors, executors, administrators or other personal or legal
representatives may have, including without limitation, all claims at law or in
equity of every nature and kind, known and unknown, suspected or unsuspected,
presently existing or which may arise in the future caused by, arising from,
related to or otherwise attributable to the actions or omissions on the part of
any provider or otherwise arising in connection with your purchase, redemption,
booking, cancellation, exchange, and/or participation in an Incredible Days
experience.
If any provision of this agreement is found to be invalid or unenforceable in any respect, the validity and enforceability of the remaining provisions shall not be affected. All clerical errors are subject to correction. The failure of Incredible Days to enforce at any time any of the provisions of the agreement shall not be construed to be a waiver of such provisions or the right of Incredible Days to enforce such provisions in the future. Any disputes arising under this agreement shall be resolved, if not sooner settled, by a state or federal court of competent jurisdiction located in the Commonwealth of Massachusetts, U.S.A., and the recipient hereby irrevocably submits to the exclusive jurisdiction of such courts.
